Job Description:

Locum Prosecutions Lawyer – Full Time – Predominantly Remote Working – 3 months + - up to £55 per hour – Midlands
Position: Locum Prosecutions Lawyer
Organisation: Midlands based Local Authority
Duration: 3 months + with a strong possibility of extension
Working Hours: Full Time
Working Arrangement: Predominantly Remote Working, with court attendance on occasion
Hourly Rate: Up to £55 Umbrella (Dependent on experience)
 
The Local Authority is ideally looking for a candidate who has prior experience in handling Prosecution matters on behalf of Local Authorities.

Duties may include:
  • Managing a caseload and providing legal advice on prosecution matters, with a focus on Education Act offences (irregular attendance and home‑schooling compliance) and Environmental offences, including fly‑tipping and duty‑of‑care breaches
  • Conducting case preparation and case management for court, reviewing evidential sufficiency and public interest, ensuring CPIA‑compliant disclosure, and working closely with Education Welfare, Environmental Health, and Waste Enforcement teams
  • Preparing briefs for Counsel, liaising on trial strategy, witness requirements, and mitigation, and attending court for mentions, directions hearings, trials, and sentencing
  • Drafting and reviewing prosecution documents such as charges, witness statements, exhibits, schedules, FPNs, and case summaries, ensuring PACE compliance and accurate case presentation
  • Advising on and progressing appropriate disposals, including FPNs, formal cautions, and prosecutions, and seeking costs and ancillary orders where appropriate
  • Reviewing casework to ensure high standards and compliance with CPIA, PACE, Data Protection, safeguarding requirements, and organisational enforcement policies
