Job Description:

Planning Legal Assistant - St Albans (Local Authority role)

Initial 3-6 month contract
Hourly Rate: Negotiable, Umbrella (Indicate rate sought)
 
37 hours per week. Full time, Monday to Friday. (Will consider Part-time too)
Experienced Paralegal who can hit the ground running immediately with minimal supervision/support
 
Responsibilities:
 

Admin duties

  1. Bundles:  Assist with preparing bundles for various types of cases (e.g. possession and tribunal cases.)
  2. Post: where post is not fully scanned by post room, LA to assist by locating paperwork, scanning full document and sending to me via email.
  3. Printing: Print, collate and post documents to be sent to court and defendants.

Letters Before Action (in relation to Compliance):

  1. Send out Letters Before Action in respect of outstanding gas inspections under lawyer supervision
  2. Send out Letters Before Action in respect of outstanding electrical inspections under lawyer supervision

Gas Injunctions:  

  1. Preparation of the full application for gas injunction to court which entails:
  2. Preparing the N16A Injunction Application Form
  3. Preparing the claim form
  4. Preparing the first draft of the client’s witness statement (WS)
  5. Preparing draft injunction order
  6. Preparing Statement of Costs
  7. Finalising signed WS by collating this with exhibits
  8. Preparing letter to court
  9. Printing out all the above in finalised and signed format and sending out to court to be issued.

Post issue of Injunction Application:

  1. Send Notice of Hearing to client
  2. Check Notice of Issue and where necessary give documents to client to serve on tenant
  3. Once served, send Certificate of Service (prepared by client) to the court in advance of hearing
  4. In the event of two hearings at different courts on same day, or annual/sick leave, LA to attend court hearing itself (if allowed to do so.)

Pre-Action Disrepair Cases

  1. Create Explorer file and save Letter Before Action (LBA) and associated documents into file
  2. Create Iken File and import LBA and associated documents into Iken
  3. Input case onto KPI spreadsheet
  4. Instruct Bevan Brittan by uploading LBA onto Bevan Brittan’s High  Q portal  & posting message to the portal
  5. Email clients informing them that BB instructed & attach LBA
  6. Stay across ensuing emails and import into Iken

Homeless Appeals

  1. Create explorer file and save appeal papers there
  2. Create iken file and import appeal papers
  3. Email appeal papers to client and seek authorisation regarding getting counsel’s advice on merit
  4. Once authorised, draft instructions to counsel and send them housing file
  5. Send housing file to solicitors on other side as part of disclosure and liaise with them
  6. Diarise directions and comply with same
  7. If appeal proceeding, seek authorisation from client for counsel to draft skeleton. 
  8. File and serve skeleton when required.
  9. If necessary, LA to attend court hearing itself (if allowed to do so.)

Ad-hoc Work as it arises, e.g.:

Unauthorised Encampments which entail:

  1. Liaising with internal departments to collate key information
  2. Liaising with Gypsy and Traveller Unit at HCC when the encampment involves travellers to ask them to undertake welfare and education visit and feedback
  3. If using the Common Law, to prepare a common law notice and arrange for service of same by client or by bailiff
  4. If proceeding via Magistrates’ Court, prepare summons, complaint and order. Also liaise with Listing Office as required.

Pre-Action Protocol (PAP) Letters:

  1. When needed attending meetings with clients alongside a lawyer to absorb key case points
  2. Prepare first draft of reply to PAP letter as a starting point for me to work from
